Detention Reviews

Individuals who are detained by the Canada Border Services Agency (CBSA) have the right to an independent hearing to review why they are being detained. CBSA detains the individual and notifies the Immigration Division (ID).

If you are a permanent resident or foreign national and have been detained, you have the right to an independent hearing to review why are being detained. Detention Reviews are held to discuss your release, removal from Canada or your continued detention. The first detention review is held within 48 hours of being detained, the second review is held within 7 days of being detained, and then there are detention reviews every 30 days until their release or removal from Canada.
